Airplaco Equipment Company (The “Manufacturer”) hereby warrants each new machine to be free from defects in material and workmanship, under normal use and service, for a period of 60 days after the date of delivery to the original retail purchaser, but not to exceed 30 days of service. The liability under this warranty is limited to replacement or repair at the Manufacturer’s factory, or at a point designated by the Manufacturer, or such part as shall appear to the Manufacturer upon inspection to have been defective in material or workmanship. The Manufacturer shall not be responsible for freight or transportation charges in connection with the replacement or repair of defective parts.

Manufacturer shall not be obligated to repair or replace any part which has been subject to misuse, negligence, alteration or failure to comply with the Manufacturer’s operating instructions. The Manufacturer makes no warranty with respect to trade accessories, engines, electric motors, hydraulic motors or any other parts or accessories not manufactured by the Manufacturer.

This warranty is provided in place of any and all other representations or express or implied warranties, including merchantability and fitness for a particular purpose. The Manufacturer makes no other representations, warranty or promise with respect to its products other than is set forth herein and no person is authorized to make any representation, warranty or promise on behalf of the manufacturer other than as set forth herein. All implied warranties that exceed the aforestated obligation are hereby disclaimed by manufacturer and excluded from this agreement.

In no event shall the Manufacturer be liable for loss of profits, indirect, special or consequential damages.
